GENERAL TERMS AND CONDITIONS OF TOURISM SERVICE
CONTRACTING EXPLORE TIERRA DEL FUEGO

These General Terms and Conditions regulate the contracting of tourism services offered by Explore Tierra del Fuego, with domicile in Ushuaia, Province of Tierra del Fuego, Argentine Republic (hereinafter, “the Agency”), and the passenger/client (hereinafter, “the Passenger”).

Contracting any service implies full knowledge and acceptance of these conditions, in accordance with Argentine Tourism Law No. 18,829, Consumer Protection Law No. 24,240, the Argentine Civil and Commercial Code, and all applicable complementary regulations.

1. NATURE OF THE AGENCY

The Agency may act as:
Direct organizer of its own excursions, or
Intermediary between the Passenger and independent service providers (transportation, navigation, train services, restaurants, or others).

In cases of intermediation, the Agency’s responsibility is limited to the proper management of the reservation.

2. BOOKINGS AND PAYMENTS

Reservations will be considered confirmed only when:
– the corresponding payment (full or partial) has been received, and
– the service voucher and/or invoice has been issued.

Payments made prior to final confirmation are considered on account of the final price.

Prices may be modified without prior notice until confirmation due to:
– cost variations
– availability
– exchange rate fluctuations
– operational conditions of suppliers

3. INCLUDED AND NOT INCLUDED SERVICES

Included services are exclusively those detailed in:
– the official excursion description, and
– the confirmation voucher.

Not included, unless expressly stated:
– National Park entrance fees
– End of the World Train tickets or optional excursions
– meals, beverages, or personal expenses
– tips or gratuities
– travel insurance or assistance services
– costs arising from flight, cruise, or third-party service changes not contracted with the Agency

4. CANCELLATIONS AND REFUNDS

By the Passenger:
– More than 48 hours before the service → full refund.
– Within 48 hours or no-show → non-refundable.

When third-party providers apply stricter policies, their conditions shall prevail, and will be informed prior to confirmation.

By the Agency:

The Agency may cancel services due to:
– adverse weather conditions
– safety reasons
– minimum capacity not reached
– force majeure

In such cases, the Passenger will only be entitled to a refund of amounts paid for services not provided, without additional compensation.

5. OPERATIONAL MODIFICATIONS

For weather, safety, or operational reasons, the Agency may:
– modify schedules
– alter itineraries
– replace activities with equivalent alternatives

without generating any right to compensation, provided the essential nature of the contracted service is maintained.

6. LIABILITY

La Agencia no será responsable por:
– weather or natural events
– delays, cancellations, or failures of third-party providers
– missed connections with flights, cruises, or other transport
– loss or damage to luggage or personal belongings
– personal decisions made by the Passenger during the excursion

Passengers are strongly advised to obtain appropriate travel insurance.

7. DOCUMENTATION AND PHYSICAL CONDITION

It is the Passenger’s sole responsibility to:
– hold valid travel documentation
– comply with migratory or health requirements
– have a physical condition suitable for the activity

Inability to participate for personal reasons does not generate the right to a refund.
The Agency may deny participation to any person whose physical condition or behavior represents a risk to themselves or the group.

8. PASSENGER CONDUCT

Passengers must maintain respectful and safe behavior.
The Agency may exclude any person who disrupts the normal development of the activity, without refund.

9. RIGHT OF WITHDRAWAL

For electronic purchases, the Passenger may exercise the right of withdrawal within ten (10) calendar days from the date of contracting, provided the service has not yet begun, in accordance with Article 34 of Argentine Law No. 24,240.

10. PERSONAL DATA PROTECTION

Personal data will be processed in accordance with Argentine Law No. 25,326 and used solely for the proper provision of contracted services.

11. JURISDICTION AND APPLICABLE LAW

Any dispute shall be submitted to the Ordinary Courts of Ushuaia, Tierra del Fuego, Argentine Republic, under Argentine law.

12. ACCEPTANCE

Contracting any service implies full acceptance of these General Terms and Conditions.
